The call data may be processed for the purposes of providing our services, ensuring the quality of our services, dealing with complaints and queries, and maintaining backups. The legal basis for this processing is consent and our legitimate interests, namely the proper administration of our business, record-keeping, improving our services, training, and the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.
    14. We may process any of your personal data identified in this policy where necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

We may process any of your personal data identified in this policy where necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, or obtaining professional advice. The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks.
    16. In addition to the specific purposes for which we may process your personal data set out in this Section 2, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

  3. Automated decision-making
    1. We will use your personal data for the purposes of automated decision-making in relation to granting access and accepting orders on our online services.
    2. This automated decision-making will involve monitoring traffic to our servers for any suspicious activity. We protect from brute force attacks against our online services by allowing up to 5 username login attempt failures, or 5 failures from a given IP address, within 60 minutes after which the username and/or IP will be blocked from further attempts for 15 minutes. If an IP continues to generate failed logins it will be blocked for 24 hours once it reaches 10 failed login attempts. We also use BitNinja and ModSecurity to protect against XSS, DDoS, malware, scans, script injection, enumeration and other automated attacks.     3. The significance and possible consequences of this automated decision-making are that you are denied access to our online services, or that we do not accept an order to provide you with a product or service.
  4. Providing your personal data to others
    1. We may disclose your personal data to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
    2. We may disclose your account data, profile data, and service data to our suppliers or subcontractors insofar as reasonably necessary for the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.     4. Financial transactions relating to our website and services may be handled by our payment services providers. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds.     5. Incoming telephone calls may be handled by our call handling service provider. We will share call data with our call handling service provider only to the extent necessary for the purposes of logging information from you during busy times or out-of-hours. Call data may also include additional categories of personal information that you disclose to us during the call.     6. In addition to the specific disclosures of personal data set out in this Section 4, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
  5. International transfers of your personal data
    1. In this Section 5, we provide information about the circumstances in which your personal data may be transferred to countries outside the European Economic Area (EEA).

    3. The hosting facilities for our websites are situated in the United Kingdom.

Amazon provide one of our storage locations for backups of customer data, however we use a location based in EU (London). Transfers to AWS will be protected by appropriate safeguards, namely Privacy Shield Certification, the use of Standard Contractual Clauses, ISO 27001 certification, ISO 27017 certification, and ISO 27018 certification.
    6. Autotask Corporation (Autotask) is situated in the United States of America. Autotask provide our primary remote management, access and control software and may be used to store usage data and service data; it may also provide access to customer data. Transfers to Autotask will be protected by appropriate safeguards, namely SAS70 certification, PCI DSS certification, ISO 27001 certification, and FISMA certification.
    7. Avast (Avast) is situated in the United States of America. Avast provide our primary antivirus and anti-spyware software. Transfers to Avast will be protected by appropriate safeguards, namely administrative, technical and physical.
    8. Birch Grove Software, Inc. (ActivTrak) is situated in the United States of America. ActivTrak provide one of our web content monitoring/filtering services. Transfers to ActivTrak will be protected by appropriate safeguards, namely administrative, technical and physical.
    9. Campaign Monitor has office in San Francisco and Sydney. Campaign Monitor provides email marketing and automation systems. Transfers to Campaign Monitor will be protected by appropriate safeguards, namely HIPAA certification, PCI-DSS certification, SOC 1/2/3 certifications, FISMA/NIST certification, IRAP certification, ISO 27001 certification, and ISO 27018 certification.
    10. Cisco is situated in the United States of America. Cisco provide one of our web content monitoring/filtering services (OpenDNS). Transfers to Cisco will be protected by appropriate safeguards, namely Privacy Shield certification, Binding Corporate Rules, the use of Standard Contractual Clauses, and ISO 27001 certification.
    11. cPanel is situated in the United States of America. cPanel are our primary provider of secure SSL certificates. Transfers to cPanel will be protected by appropriate safeguards, namely Privacy Shield certification, and the use of Standard Contractual Clauses.
    12. Enom LLC (Enom) is situated in the United States of America. Enom provide our domain registration service. Transfers to Enom will be protected by appropriate safeguards, namely administrative, technical, physical, and the use of Standard Contractual Clauses.
    13. Google is situated in the United States of America. Google provide storage locations for files, backups and email services. Transfers to Google will be protected by appropriate safeguards, namely Privacy Shield Certification, the use of Standard Contractual Clauses, ISO 27001 certification, ISO 27017 certification, and ISO 27018 certification.
    14. LogMeIn, Inc. (LogMeIn) is situated in the United States of America. LogMeIn provide our secondary remote access and control software and may be used to store usage data and service data; it may also provide access to customer data. Transfers to LogMeIn will be protected by appropriate safeguards, namely Privacy Shield Certification, and the use of Standard Contractual Clauses.
    15. Microsoft is situated in the United States of America. Microsoft provide storage locations for files, backups and email services. Transfers to Microsoft will be protected by appropriate safeguards, namely Privacy Shield Certification, the use of Standard Contractual Clauses, ISO 27001 certification, ISO 27017 certification, and ISO 27018 certification.
    16. Zendesk, Inc. (Zendesk) is situated in the United States of America. Zendesk provide our ticketing system and may be used to store usage data, account data, profile data, service data, enquiry data, and call data. Transfers to Zendesk will be protected by appropriate safeguards, namely Binding Corporate Rules, Privacy Shield Certification, the use of Standard Contractual Clauses, ISO 27001 certification, SSAE-16 certification, and PCI DSS certification.

    18. You acknowledge that personal data that you submit for publication through our website or services may be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others.
  6. Retaining and deleting personal data
    1. This Section 6 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.
    2. Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
    3. We will retain your personal data as follows:
      (a)    Account data will be retained while there is an active contract in place and for a minimum of 6 years and maximum period of 10 years after the date of the termination of the last contract.
      (b)    Profile data will be retained while there is an active contract and for a minimum of 6 years and a maximum period of 10 years after the date of the termination of the last contract.
      (c)    Enquiry data will be retained for a minimum period of 6 years and a maximum period of 10 years after the date of the enquiry.
      (d)    Transaction data will be retained for a minimum period of 6 years and a maximum period of 10 years after the date of the transaction.
      (e)    Correspondence data will be retained for a minimum period of 6 years and maximum period of 10 years after the date of the correspondence.
      (f)    Call data will be retained for a minimum period of 6 year following the date of the call, and for a maximum period of 10 years following the date all services with Cultrix are cancelled or terminated and your account is closed.
    4. In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the following criteria:
      (a)    the period of retention of Usage data will be for a minimum period determined by the storage space available for this data, and a maximum of 10 years.
      (b)    the period of retention of Service data will be while there is an active contract and for a maximum period of 10 years after the date of the termination of the contract.
      (c)    the period of retention of Publication data will be determined based on the outcome of an audit when reviewing our online content, normally when redeveloping our websites from time to time.
      (d)    the period of retention of Notification data will be a maximum of 10 years after you unsubscribe from all notifications.
      (e)    the period of retention of Customer data will be as specified in the backup policy and only while the backup service contract is active. Customer data is only retained where we provide you with a backup service contract.
      (f)    the period of retention of Hosted data will be while there is an active hosting contract and for a maximum period of 90 days. Where a hosting backup service contract is also active, the backups of the hosting data will be retained for a maximum period of 3 months.
    5. Notwithstanding the other provisions of this Section 6, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
  7. Security of personal data
    1. We will take appropriate technical and organisational precautions to secure your personal data and to prevent the loss, misuse or alteration of your personal data.
    2. We will store all your personal data on secure servers, personal computers and mobile devices, and in secure manual record-keeping systems.
    3. The following personal data will be stored by us in encrypted form: password(s).
    4. Data relating to your enquiries and financial transactions that is sent from your web browser to our web server, or from our web server to your web browser, will be protected using encryption technology.
    5. You acknowledge that the transmission of unencrypted (or inadequately encrypted) data over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.
    6. You should ensure that your password is not susceptible to being guessed, whether by a person or a computer program. You are responsible for keeping the password you use for accessing our website confidential and we will not ask you for your password (except when you log in to our website).

    5. In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure.     1. Our website and services are targeted at persons over the age of 18.
    2. If we have reason to believe that we hold personal data of a person under that age in our databases, we will delete that personal data.

    1. Please let us know if the personal information that we hold about you needs to be corrected or updated.
  13. Acting as a data processor
    1. In respect of customer data and hosted data, we do not act as a data controller; instead, we act as a data processor.
    2. Insofar as we act as a data processor rather than a data controller, this policy shall not apply. Our legal obligations as a data processor are instead set out in the contract between us and the relevant data controller.
  14. About cookies
    1. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server.
    2.
